MINIMUM ORDER (Effective January 1, 2022)

Order minimum $600.00 (net of freight):

Quantity minimum:

  • 50 lbs. minimum per item for manufactured products (non-catalog)

INTERNATIONAL ORDERS/EXPORT

  • All orders outside North America require the 50lbs. minimum per item for manufactured/custom blends (non-catalog) plus a $2,000 order minimum
  • This requirement is necessary to cover the additional work incurred to complete international documentation

SAMPLE ORDERS

Lebermuth recognizes the importance of shipping samples. Preparation of samples and shipment of samples can be costly (reference the HAZARDOUS (DANGEROUS GOODS) SHIPPING INFORMATION FOR OIL herein, for more details). Your sales representative and/or customer service representative will quote you pricing for samples you may request.

BACKORDERS

Back-ordered essential oils, flavors, and fragrances will be shipped as expeditiously as possible. Please contact customer service if you do not want us to ship any back-ordered item(s).

ADD-ONS

Orders for all in-stock items received by 10:30 a.m. should ship within 5 business days. If you need to add to your original order, the item(s) added will be treated as separate orders even if placed on the same day as the original order. 

QUANTITY PRICE BREAKS

The more you buy, the more you save. Purchases in quantities greater than those listed on our eCommerce website (sizes of 25 lbs or less) are negotiated and based upon current market conditions. Please call customer service or your Account Executive for further information.

PRICE CHANGES

Due to unforeseen market fluctuations, prices are subject to change without notification.

BLANKET ORDER POLICY

  • Order Confirmation and Timeline:
    • The total amount of the blanket order placed by the customer must be taken within one year of receipt of order confirmation.
    • The order confirmation date serves as the starting point for the execution of the blanket order.

  • Inventory Allocation and Billing:
    • Customers are responsible for the allocation of the inventory specified in the blanket order within the agreed-upon timeline.
    • Any inventory remaining after one year from the order confirmation date will be billed and shipped to the customer.

  • Lebermuth's Commitment:
    • Lebermuth agrees to source and store the materials associated with the blanket order at the agreed upon price listed on the order confirmation.
    • Storage and maintenance of inventory will be managed by Lebermuth as part of the service.

  • Amendments and Modifications:
    • Any amendments or modifications to the blanket order, including changes in quantities, pricing, or delivery schedules must be communicated in writing and agreed upon by both parties.
  • Billing Process:
    • Invoices for any remaining inventory after one year from the order confirmation date will be sent to the customer's billing address on file.
    • Payment terms and conditions for the remaining inventory will follow the standard terms agreed upon in the initial agreement.
  • Termination of Agreement:
    • In the event of termination of the blanket order agreement, any remaining inventory will be billed to the customer as outlined in the terms of termination.

VERBAL ORDERS

Verbal orders can cause shipping errors. In order to avoid these types of errors, we strongly urge you to place your orders in writing.

Your written order confirmed by our Sales Department will guarantee you will be shipped what you ordered. Of course, we will continue to accept verbal orders, if this is your preferred method of communicating. However, any expense(s) incurred due to order or shipment errors from verbal orders that were not confirmed in writing will be the customer's responsibility (See RETURNS AND CREDITS). At your request, we will confirm your order in writing via e-mail. Please be sure we have your current e-mail address on file. 

For standard stocked Essential Oils & Fragrances, you can shop online at your convenience at our secure eCommerce website https://shop.lebermuth.com  and you will receive an order confirmation email. For orders not available on our eCommerce website, you can contact your Account Executive or email sales at info@lebermuth.com. 

REPACKING CHARGES

If repacking into 3 or more containers is required, Lebermuth reserves the right to apply additional repackaging charges to your invoice. Please contact Customer Service or your Account Executive for more details 1.800.648.1123.

RECERTIFICATION FOR EXPIRED MATERIALS 

Lebermuth offers re-testing of any expired materials purchased from Lebermuth. There is a testing fee is $250 per item and we will require a ½ oz sample. If you wish to have a material re-tested, please contact Customer Service or your Account Executive for instructions at 1.800.648.1123.

INTELLECTUAL PROPERTY 

Our Fragrances and Flavors (compounds) are creations that enable our clients to build their brands and make the world taste and smell better! These creations are tangible art and the efforts and expenses related to creating and maintaining the art are significant. Like art, our compounds are to be considered proprietary. Lebermuth Flavors and Fragrances are intellectual property. Our compound formulations are trade secrets. Lebermuth compounds are not to be reversed engineered, de-compiled, or utilized to re-create any likeness thereof. Doing so is prohibited.

WARRANTY

Lebermuth warrants that our Products will be free from defects in material and workmanship and will substantially conform to technical specifications for the Products. This Warranty will extend for a period of thirty (30) days from the date the Products are shipped to Buyer.  This Warranty gives the Buyer the right to have the defective Product replaced free of charge (labor, travel expenses, and other costs related to the repair not included). Lebermuth reserves the right to inspect the defective Product on its return in order to determine the origin of default, and if the defect is found not to be covered by the Warranty shall be void to the extent of (i) any modification of a Product by any person or entity other than Lebermuth, (ii) misuse or abuse of a Product or documentation Purchaser or Purchaser’s customers or end-users, (iii) negligence or wrongdoing of Purchaser or Purchaser’s customers or end-users, (iv) accident, disaster or event of force majeure, (v) use of a Product or documentation in any manner inconsistent with our Ordering Information, (vi) improper storage of a Product, (vii) use of a Product in combination with products, equipment or software not supplied by Lebermuth or by Purchaser or (viii) use of a Product in combination with products supplied by Purchaser without Lebermuth’s technical approval. 

DISCLAIMER OF WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  EXCEPT FOR THE WARRANTY SET FORTH IN THE WARRANTY SECTION, LEBERMUTH DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, ORAL OR WRITTEN, WITH RESPECT TO THE PRODUCTS, INCLUDING WITHOUT LIMITATION, ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PURPOSE. Laws from time to time in force in certain jurisdictions may imply warranties that cannot be excluded or can only be excluded to a limited extent, and this Agreement shall be read and construed subject to any such statutory provisions. Purchaser shall be responsible for any warranty it extends, either directly or indirectly, expressly or by operation of law, beyond the warranty expressly granted in Section 4 (Warranty). Lebermuth is not responsible for (i) damages caused by Purchaser’s failure to perform Purchaser’s responsibilities or (ii) damages due to deterioration during periods of storage by Purchaser longer than those periods set forth in the Product documentation.

FREIGHT

Lebermuth has multiple shipping facilities. Essential oils, flavors, and fragrances are sold F.O.B. If split shipments are required, your customer service or sales representative will inform you at the time your order is confirmed.

“DAMAGED” & “SHORTED” SHIPMENTS

Merchandise that arrives at your facility damaged must be received and documented correctly. Failure to sign a bill of lading “damaged” and/or “shorted” for goods that shipped via an LTL (less than truckload) carrier such as Old Dominion or FedEx Freight, voids your right to claim compensation from the trucking company and Lebermuth.

Our processing of a claim (on your behalf) for merchandise shipped via UPS or FEDEX requires us to conform to the carriers’ claims policy.  Damaged merchandise must be kept in the original container, sealed, and with the product inside until a UPS or FEDEX Representative has inspected the damages. Photos of the damaged container along with the Representative’s documentation should be forwarded to our customer service department. We will then begin processing a claim with UPS or FEDEX.

HAZARDOUS (DANGEROUS GOODS) SHIPPING INFORMATION FOR OILS

Shipments of our products that have a flashpoint of 60.0° Celsius (°C) but above 38.0° Celsius (°C) are considered hazardous materials when shipped via air or ocean transportation.

Shipments of our products that have a flashpoint of 38.0° Celsius (°C) or less are considered hazardous materials when shipped via ground transportation.

Certain products are considered hazardous via any mode of transportation by their own definition.

Some international countries do not accept hazardous material shipments.

Any products designated as hazardous material must be packed according to regulations and may incur higher shipping costs and longer shipping times. Since some hazardous classes can only be shipped using specific carriers and shipping modes, Lebermuth reserves the right to choose the carrier & mode of transportation for hazardous shipments. Please contact Customer Service or your Account Executive for any questions relating to hazardous shipments.

To learn the flashpoints of the products you are purchasing, please visit Lebermuth’s Regulatory Portal to review the regulatory documentation associated with the item you are purchasing. Law requires you to have SDS, and other regulatory documents, which we will provide to you.

STORAGE OF OILS

Essential oils, fragrances, flavors, and F&F ingredients have a limited shelf life. Proper storage of these items will ensure your inventory does not prematurely deteriorate. Oils should be stored in full, tightly sealed containers. Be sure your oils are stored away from direct light in a cool place (60 to 70° Fahrenheit). For long-term storage of oils (more than 180 days), we recommend you nitrogen blanket the headspace of your containers to ensure preservation. Citrus Oils should be stored in cool storage (35-45° Fahrenheit) Further information regarding the use and storage of any item can be found on the Certificate of Analysis and Safety Data Sheet documentation.

DEA STATEMENT

Items designated “DEA” are regulated materials. In order to purchase these materials, you must provide a copy of the DEA (Domestic Chemical Diversion Control Registration) Certificate along with the signature of your authorized buyer on our form “Authorized Buyers of DEA Regulated Products.” To obtain this form or to receive more information about buying regulated items, please call Lebermuth’s customer service department.

CREDIT TERMS/PAYMENT OPTIONS

If you do not have an established line of credit with our company, you may pay for your merchandise by using Visa®, MasterCard®, Discover® or American Express®. For your convenience, Lebermuth has a secure and encrypted payment portal on our website. Both credit and debit cards are accepted. We recommend you use this utility when choosing to pay your bills with a credit or debit card. Contact Lebermuth’s accounting department if you have questions on how to use this utility.

You may request we establish a line of credit for your company. To establish a credit line, please complete and submit our credit application to our accounting department (customer service will be happy to email or mail you a copy). It will take approximately four weeks to process your application. A copy of your company’s General Resale Certificate and General Sales Tax Exemption Certificate from your state must be included with the credit application form.

Returned checks are subject to a $30.00 fee.

Prepays are not accepted.

All merchandise ordered is payable in U.S. funds.

FINANCE CHARGES

A maximum finance charge of 2% per month (24% per annum) will be assessed to any past-due balance.

SPECIAL SERVICES

Lebermuth regularly processes F&F items using its fractional distillation stills. Should you require toll distillation services please work with your sales representative.

REGULATORY

Lebermuth understands the nature of the regulatory environment we live in. We provide many regulatory documents, you can find your product(s) necessary documents on Lebermuth’s Regulatory Portal https://www.lebermuth.com/portal on our website: www.lebermuth.com.

CONDITION OF SALE

All products are sold on a wholesale basis; i.e. sold for further processing, used to manufacture other products, or to be resold.

LIMITATION OF PRODUCT LIABILITY

Lebermuth employs a number of quality control checks prior to shipping your order ensuring that errors are kept to a minimum. If a mistake is made, we will be monetarily liable for the error limited to the sales cost of the merchandise shipped and the freight charges (when sold F.O.B. from one of our facilities).

Upon receipt of your merchandise, please check the goods carefully. Fragrances, flavors and essential oils, F&F ingredients should be carefully reviewed. Double-check our item numbers with the original samples and paperwork you received. For those products that require manufacturing production batches, we strongly recommend you run a test batch using any new item received before implementing a full production run. This will ensure that should there be any problems, they can be corrected without incurring a large loss.

Our clients rarely experience problems with the raw materials we ship to them. However, we feel it is extremely important to emphasize that we are in a partnership with you. Both Lebermuth’s and your quality controls will help our companies succeed.

SHIPMENT POLICY & NOTIFICATION

Most orders for in-stock items should ship within 5 business days after receipt.  Special ordered manufactured items such as fragrances and flavors will ship in approximately 8 business days (assuming all components are on-hand and have passed quality control). Shipment lead-time for products that require distillation will vary. Customer service can provide you with this information. During our busy season (June through November), orders may take longer to process. 

Orders that ship via UPS or FedEx ground require your signature for delivery. If you would like to waive this requirement, please notify customer service.  As a general rule, orders weighing in excess of 300 pounds typically ship by common carrier.  If you do not have a discount program with a specified carrier, we will suggest one so that you will receive our discount. 

If your order will be shipping via UPS, FedEx, or common carrier, we can e-mail you an automatic shipment notification alerting you your order has shipped. The notification will include the carrier’s tracking, airway bill, or pro number allowing you to track your order. Please be sure we have your current e-mail address on file by including it on your order or when speaking with one of our customer service representatives.

CANCELLATIONS

Orders not in WIP (work in process) and not shipped within 2 business days of the requested shipment date are cancelable without incurring restock fees.

This cancellation policy does not apply for any blanket order (aka Guaranteed Minimum Purchase Agreements) or for any item ordered for future delivery, which at the time the order was issued, had not been available for immediate shipment.

If an order requiring manufacturing or compounding is WIP, cancellations are not acceptable. 

All shipped orders and customer pick-ups are subject to our Returns and Credits Policy. 

RETURNS AND CREDITS

Returned merchandise is subject to a 20% re-stocking and handling fee.

All claims for returns must be made within TEN (10) days of receipt of goods by calling Lebermuth’s customer service department.  No returns will be accepted after 30 days. At the time of your call, if your return is authorized, you will be provided with a Return Materials Authorization (RMA) number. Each piece you return must be clearly labeled with the correct Lebermuth facility address, which will be provided to you by Customer Service along with an RMA number. Failure to include this RMA number on each of the returning containers will result in a delay in processing your credit.

Return of Food Grade materials is subject to Safe Quality Food (SQF) standards and must be compliant with our SQF regulations.

  • Food-grade items packaged in original Lebermuth packing, unopened, with Lebermuth’s tamper seals intact, can be returned
  • Food-grade items that had been opened in a food-grade FSMA (Food Safety Modernization Act) certified facility are eligible for return. Clients must provide Lebermuth’s Quality Assurance department with documentation confirming the client’s facility is certified. Prior to returning the goods, customers must seal all containers with their Company’s tamper-evident seal.
  • Food-grade items opened in a non-food-grade certified plant cannot be returned.

To receive full credit, all merchandise returned must be in good, saleable condition and packed in the original container. Every container should be properly sealed.  Full credit is subject to our evaluation and approval of the condition, quality, and salability of the returned merchandise.
